Contingency Patent Litigation Counsel (Lead) — U.S. Patent Family for Sensor-Infused Real-Time AI Agents

MetaBrain Labs is retaining lead contingency patent litigation counsel to drive enforcement and monetization of a foundational U.S. patent family in an emerging category: sensor-infused conversational/agent systems that adapt in real time based on live data. This architecture is rapidly showing up across health, wellness, wearables, industrial IoT, and ambient/edge products. The portfolio is led by U.S. Patent No. 11,996,179 B2, granted in 2024 with a priority date to 2021—predating the market’s post-ChatGPT rush into “agentic” systems. A continuation-in-part (CIP) is also in progress and is expected to further strengthen and extend the claim set as the category matures. We are a practicing entity. We build and deploy the underlying architecture in real products and workflows, and we understand the commercial terrain. Early in this process, we also commissioned a formal opinion letter as part of diligence and positioning. This is not a “start from scratch” matter. Over the last 7 months, we have built a streamlined enforcement pipeline and prepared evidence packages across 130 companies, with 30+ already in active discussions. We have identified 9 priority targets that are ready for a step-up in posture. To date, we have approached targets as a business discussion: professional outreach, education on our patent position, and an invitation to engage commercially—without inflammatory language. For each of the escalation-ready targets, we have made at least two outreach attempts. Those efforts have not resulted in substantive engagement. We are now prepared to proceed to the next step with a disciplined escalation path, including negotiation under credible litigation threat and, where warranted, filing suit. This matter also offers meaningful upside beyond enforcement. Because the patent family is foundational, it can create a defensible moat for the right partners. We can structure strategic relationships where a license is not merely permission, but an advantage—clear coverage for a specific workflow, product line, or distribution channel. The breadth of the patent also makes it well-suited to vertical slicing. We can offer field-of-use licensing packages by vertical and workflow—health/RPM, consumer wellness, trials, industrial operations, in-vehicle/ambient assistants—each with its own commercial terms and escalation strategy. That creates multiple parallel paths to resolution and supports efficient portfolio monetization rather than a single, monolithic campaign. Your scope (what you will be doing)

• Define escalation strategy and venue approach; select defendants and timing
• Lead negotiations and settlement architecture under credible litigation posture
• File suit when appropriate and run the case through resolution (pleadings, discovery, experts, Markman, dispositive motions, trial readiness)
